Expungement (also called expunction by some lawyers) is a way that an offender can remove arrests and convictions from their criminal record. In Kansas, when a charge is expunged from someone’s criminal record, it’s gone forever. Essentially, it ceases to exist. Potential employers or landlords won’t be able to see any record of an arrest from a background check. The offender can legally answer “no” if someone asks whether they’ve been convicted of a crime. Even court officials like judges won’t be able to see any record of the offender’s arrest. That can be helpful if the offender is ever charged with another crime in the future.

In Missouri, expungement is a little more limited in its scope. Courts, certain employers, and law enforcement agencies will still be able to view expunged records. Additionally, an offender needs to wait at least seven years before they and their lawyer can file for expungement or expunction.

In Kansas, there are two separate rules regarding expunction. In one case, an offender was arrested and convicted of a crime. The court usually grants requests based on these criteria:

In Missouri, expungement standards are slightly different. In general, Missouri law assumes that an offender can expunge a crime from their criminal record unless otherwise stated. Some crimes that an offender cannot expunge from their record include:

  • Violent Class A felonies

  • Sex offenses

  • Dangerous felonies

  • Drunk driving

  • Domestic assault or abuse

  • The jury found them not guilty

  • The court suspended sentencing
